The United Nations Conference on Trade And Development (UNCTAD) is the part of the United Nations Secretariat dealing with trade, investment, and development issues. The organization’s goals are to maximize the trade, investment and development opportunities of developing countries and assist them in their efforts to integrate into the world economy on an equitable basis.
Throughout the recent two decades, the Republic of Tajikistan’s Government has undertaken significant reforms to open the economy and introduce the market mechanisms. At present, the country’s leadership is willing to continue and deepen the structural transformation, particularly in the areas of transport infrastructure development and export diversification. Therefore, there is an urgent need for modernized and transparent Customs procedures to promote Tajikistan’s positioning as a land-linked transit country and a pro-active player in the regional trade and economic processes.
Under the World Bank funded Program, UNCTAD has recently signed an agreement with the Customs Services under the Government of the Republic of Tajikistan (CSGRT) for Reforms, Automation and modernization of Customs processes and procedures by implementation of Automated System for Customs Data (ASYCUDA) World under the Phase Four of the Central Asia Regional Links Program (CARS-4) Project of ASYCUDA Component. Administrative measures are taken to prepare the environment for implementing new Customs regimes and procedures to ensure transparency in the Customs clearance process and to fight Customs Corruption on one hand and to have simplified procedures on the other.
To fulfill the requirements for the full implementation of ASYCUDA World, a National Legal Analyst will be hired to work closely with international experts and relevant Customs Services official representatives.
Under the overall guidance and supervision of the UNCTAD National Project Manager, the National Legal Analyst will be responsible to develop draft regulatory legal acts in compliance with the recommendations proposed by UNCTAD for the Customs Service under the Government of the Republic of Tajikistan. Additionally, ensure alignment with the outcomes of further analysis. The National legal Analyst will work in close collaboration with the project team and with the Project Implementation Group.
In addition, the Administrative and all logistical arrangements of the project will be done through the United Nations Development Program (UNDP) in Dushanbe, Tajikistan; therefore, the process of recruitment will be managed through UNDP and the individual contracts will be issued accordingly
Summary of key functions:
- Analytical work that includes a description, and analysis of national, and international legislation and practice, proposed methods and tools, the list of legal acts, and a comparative table on amendments and additions to existing regulatory legal acts.
- Drafted conclusions and recommendations for changing and harmonizing legal acts.
- Presentation of all results and drafting of final documents in Tajik and Russian. Close cooperation, with the working group and representatives of Tajikistan Customs Service and other relevant government bodies.
- Help in the correct assessment of Customs duties and taxes in the ASYCUDA system so that the due revenues are collected properly into the treasury of the state/government.
- Assessment of Air Cargo, Imports, Exports and Transit regimes Profiles in ASYCUDA World System as per the standards and requirements of the Customs Act and Tariff Book.
- Assist in preparation of relevant materials/documentation for implementation of new modules or update of existing modules in ASYCUDA World System. Provide inputs in the preparation and elaboration of work plan.
- Any other task as assigned by the line supervisor.

- Examinations and evaluation of both national and international customs and customs related legislation and practices.
- Development of methods and tools for amendments to national customs and customs related legislation
- Development of list of legal acts subject to drafting and amendment.
- Development of comparative table highlighting any amendments or additions to existing regulatory legal acts.
2. Drafted conclusions and recommendations for changing and harmonizing legal acts.
- Identify any inconsistencies, gaps, or areas in need of improvement. Recommendations should outline actionable steps for harmonizing and updating legal acts to ensure coherence and effectiveness in the regulatory framework.
- Drafting and documentation of proposed recommendations for changing and harmonizing customs and customs related legal acts.
3. Presentation of all results and drafting of final documents in Tajik and Russian.
- Close cooperation, as well as consultancy work, with the working group and representatives of Tajikistan Customs Service and other relevant government bodies.
- Present results and drafting the final documents in both Tajik and Russian languages. This includes summarizing the findings, conclusions, and recommendations in a clear and concise manner for better understanding by relevant stakeholders.
- Close cooperation with the working group and representatives of the Tajikistan Customs Service and other relevant government bodies. Consultancy work may also be provided to ensure that the final documents meet the needs and requirements of the stakeholders involved. Facilitate effective communication and implementation of the proposed changes in the legal framework.
4. Help in the correct assessment of customs duties and taxes in the ASYCUDA system so that the due revenues are collected properly into the treasury of the state/government.
- Aiding in the accurate assessment of customs duties and taxes within the ASYCUDA system, this includes ensuring that the correct rates and calculations are applied to imported and exported goods in compliance with the relevant regulations and laws.
- Accurate assessment of customs duties and taxes, the due revenue collected properly and deposits into the treasure of the state government.
5. Assessment of Air Cargo, Imports, Exports and Transit regimes Profiles in ASYCUDA World System as per the standards and requirements of the Customs Act and Tariff Book.
- Evaluate profiles related to Air Cargo, Imports, Exports, and Transit regimes within the ASYCUDA World System. Conduct assessment in accordance with the standards and requirements outlined in the Customs Act and Traffic Book.
- Review and analyze these profiles to ensure the information and data stored in the system align with the legal framework and regulations governing customs procedures.
- Maintain accuracy, consistency, and compliance with the Customs Acts and Tariff Book to facilitate smooth operations and efficient management of air cargo, imports, exports, and transit activities withing the ASYCUDA World System.
6. Assist in preparation of relevant materials/documentation for implementation of new modules or update of existing modules in ASYCUDA World System. Provide inputs in the preparation and elaboration of work plan.
- Support the team in preparation of necessary materials and documentation for the implementation of new models or updates to existing modules within the ASYCUDA World System.
- Additionally, provide valuable insights and suggestions in developing work plans, outlining the steps, timelines, and resources needed for the successful implementation of the new modules and updates.
Core-Behavioral Competencies:
- Master’s degree or equivalent in Law/ jurisprudence or fields adjacent to customs law or
- A bachelor’s degree in the mentioned areas in combination of two years of experience will be given due consideration in lieu of master’s degree.
- Up to two years with a master’s degree or a minimum of two years of proven work experience in Customs, Trade, or another relevant field is required.
- Specialized training in border or customs control procedures would be an advantage.
- Proven experience in the usage of IT-based tools, processes, and MIS in support of Business process simplification and processes is highly desirable.
- Previous experience in Tajikistan Public Sector especially with Customs or Trade related matters.
Language Requirements:
- Fluency in spoken and written in Tajik and Russian languages is a must.
- Knowledge of English is an asset.
