Background

The European Bank for Reconstruction and Development (the “EBRD“) is an international financial institution established and acting on the basis of an international agreement known as the Agreement Establishing the European Bank for Reconstruction and Development dated 29 May 1990, as amended (the “EBRD Agreement“).

As an international organisation whose status, privileges and immunities are established by the EBRD Agreement, the EBRD has its own internal justice system to provide for the review and settlement of disputes of an employment or administrative nature. The system provides for: (i) a process of administrative review, involving consideration by the EBRD’s Administrative Review Committee (“ARC”) which issues a report and recommendations to the President, with the President taking a decision; and (ii) appeal to the EBRD Administrative Tribunal.

The EBRD is seeking to appoint one individual for the position of Chair of the ARC. This is not a full-time assignment, and workload will be subject to the number and frequency of cases received by the ARC.

The Administrative Review Committee

The EBRD’s ARC reviews requests submitted by staff members to the President for review of administrative decisions and provides a reasoned report and recommendations to the President for consideration prior to the President making a decision on a staff member’s request for review. The recommendations of the ARC are not binding on the President. The EBRD’s ARC consists of three members: the Chair and two assessors selected by the Chair for each review from a pool of eight staff members.

The EBRD’s ARC is supported administratively by a secretariat.

Candidate’s profile

The successful candidate will be appointed for a three-year term starting in June 2025. Candidates shall not be a current or former staff member or officer of the EBRD, or current or former member of the EBRD Board of Directors or the EBRD Board of Governors. Candidates shall be nationals of an EBRD member state.

The successful candidate shall have the following qualifications and skills:

  • A degree in law or equivalent, and qualifications required for appointment to high judicial office or as an arbitrator;

  • Extensive professional experience in the areas of employment relations, international civil service and/or the administration of international organisations;

  • Be a person of high moral character;

  • Have a high degree of professionalism, independence and impartiality;

  • Excellent drafting skills, including the ability to be concise and clear;

  • Good technology skills/know-how including ability to work in a hybrid format with online audio and web conferencing platforms; and

  • Availability for a term of three years.

The ability of the candidate to satisfy any of the following additional criteria would be advantageous:

  • Experience as a chair of a grievance or administrative review committee of other international organisations or experience as a judge on administrative tribunals of other international organisations; and/or

  • Demonstrated experience in adjudication and/or arbitration, preferably as a judge or arbitrator.

Submission

Interested individuals are invited to submit their application, including a curriculum vitae (CV) with details of prior relevant experience in the areas of employment relations, the international civil service, international administrative law, the administration of international organisations, adjudications and/or arbitration, together with a cover letter by 3 April 2025.

Selection process

As part of the selection process, the EBRD intends to interview a number of individuals who have been shortlisted on the basis of the criteria set out in the “Candidate’s profile” section. It is expected that interviews will be held in April/May 2025, either at the EBRD’s Headquarters in London, UK or virtually via a web conferencing platform. Invitations will be sent to interviewees at least seven (7) calendar days prior to the interview date. Please note, only successful candidates shortlisted for an interview will be contacted.

The ARC Chair will be appointed by the EBRD’s President for a three-year term commencing on 1 June 2025. The ARC Chair will be contracted on an annual retainer and, contingent on the number of working days, remuneration will consist of a uniform daily fee rate, plus justified expenses, as applicable.

Appointment as the ARC Chair shall not be regarded for any purposes as establishing a relationship of principal and agent, or employer and employee, or master and servant between the EBRD and the successful candidate.
