Malaria is both a cause and a consequence of poverty, affecting the most vulnerable, reducing productivity and placing an economic burden on individuals, families and national economies. Malaria remains a serious public health problem in Mozambique. The National Malaria Programme in Mozambique, in line with the WHO Global Technical Strategy (2016 – 2030), aims to reduce morbidity to less than 216 per 1000 inhabitants and malaria mortality to less than 0.77 per 100,000 inhabitants by 2030 according to the new national malaria strategic plan (2023-2030). The new Strategic Plan sets out guidelines on vector control interventions and case management, social behaviour change, as well as surveillance and response in cases of outbreaks and humanitarian emergencies to prevent and treat the disease and achieve the defined objectives.
The main malaria prevention measure is vector control and one of the biggest challenges faced is the use of prevention measures, accountability of individuals and the community as well as waste management. A solution for accountability and guarantee of the solution of these problems is the Law No. 3/222 that establishes crimes against public health. The Law no. 3/2022 was approved on January 11, 2022 and clearly establishes the rights to health of all entities, but there needs to be standards, legal obligations and accountability for the law to be applied effectively.
However, so far its regulation has not been made, hindering the implementation of the law and thus, theNMCP intends to create the regulation of the Public Health Law that will contribute to the guarantee of the rights and obligations that can be applied to allthe organs and institutions of the Public Administration, to citizens and other natural or legal persons,public or private, which contributeto the promotion of health, to the prevention and control of malaria and other diseases and to the preservation of Public Health, regardless of their social, economic condition and their political and religious convictions.
These terms of reference are intended to establish mechanisms for the hiring of the consultant.

To present the regulation of Law No. 3/2022 “crimes against public health”to the Council of Ministers respecting all legally acceptable consents and that is easy to understand and implement.
The Ministry of Health understands that to regulate Law No. 3/2022 “crimes against public health” needs to observe simplicity, perception from the point of view of application, as well as respect its application in time, without losing the genesis of the law approved and taking into account the accountability for the correct use of preventive and curative measures of malaria.
Since the regulation of the law is the practical part of its application, we understand that it is necessary to skewer all the main elements of the law that its application may not be perceived in the approved law and the regulation, needs to clearly explain the spirit of the letter present in law 3/2022.
As some aspects may not be easy for the public to perceive, it will be necessary to consult and involve the main consumers of the law so that it is not a law that its application becomes diffuse and in this case.
The consultant will lead a small team of legal experts with relevant experience in drafting laws and regulations of the Government of Mozambique. The team will coordinate at national level with the NMCP Director and Directors ofother relevant departments of the Ministry of Health in the preparation and revision of the document. The team leader will provide technical assistance to ensure that regulations are aligned with public health laws and include all areas outlined in national strategic plans.
Deliverables
The consultant must deliver the following products within 30 thirty working days:
1. Draft 01 presented and approved by MISAU (15 days)
2. Draft 02 presented and approved by the Council of Ministers (7 days)
3. Final document (7 days)
Educational Qualifications: Degree in law or legal sciences
Experience: in the context of Mozambique; Experience working with the Ministry of Health and support in the preparation of national documents as strategic plans;
Skills/Knowledge:Minimum of 01-year experience in Public Health,
Languages and level required: Portuguese – Advanced; English – Intermediate
