HOUSING LAND AND PROPERTY CONSULTANCY

1. Objective of the assignment

The objective of the consultancy is to undertake an analysis on the HLP issues in South Sudan based on existing evidence and resources and utilize this to produce a documentary film, develop the South Sudan HLP AoR strategy and technical guidance or guidelines on tenure security for HLP Actors in South Sudan.

1. Scope of Services

For the development of the documentary film, this work will involve both desktop research and key interviews on how historical land issues (land management, governance land administration) have evolved in South Sudan, their current status and the impact they have had on the people of South Sudan, including displacement affected populations and the impact they may have on current land policy development in South Sudan-

i. Documentary; the documentary film needs to portray the process and results of HLP access, land allocation and adequacy of housing in a way that is detailed, appealing, and easy to understand. The film will be used to:

a. Present in national, local meetings and workshops discussing both programmatic and policy recommendations.

b. Use as a reference for relevant levels, sectors and communities when implementing HLP in the local area.

c. Content of video should include gender sensitivity and highlight community participation in South Sudan

The main content should include:

· Brief introduction on the context of HLP in South Sudan from Displaced Persons or communities to local authorities (relevant Resolutions, difficulties, concerns, etc.)

· Project approach & key interventions

· Introduction about the HLP AoR and its work

· Achievements, impacts on displaced people’s lives

· Sustainability of these interventions

· Recommendations for stakeholders on policies and practices to promote effective implementation of HLP rights in South Sudan.

Tone

The film needs to be accessible, easy to understand, and concise.

ii. HLP AoR Strategy; developed to mobilise a comprehensive, system-wide and multi-sector effort to prevent or respond to HLP needs, violations and related protection risks facing affected populations, as well as to prevent and stop recurrences of HLP violations.

iii. HLP specific advocacy strategy; this should involve identifying the goal and defining objectives realistically. It will need to look at different approaches, depending on the specific issue and the context.

iv. Land Tenure Security Guidance Note or Guidelines; these guidelines should be based on a desk review of land evidence and in-depth consultations with experts, insights from stakeholders. The technical guide should include the pathways that are voluntary and can be tailored according to the national context in South Sudan. The aim of this document should be to present successful approaches to secure land tenure rights in both rural, peri urban and urban areas. This should consider that secure tenure has a triple dimension of legality, legitimacy, and certainty, each of which are essential to realizing the benefits within this ‘bundle of rights’.
