Thailand enforced specific legislation to reduce and address the legal status for stateless persons and undocumented persons. Thailand has made progress on the legislative aspects in 2008, 2014, 2017, and 2019. Considering that the number of registered stateless in 2023 stands at 586,548, it is crucial that bottlenecks in the implementation of the existing laws related to civil registration and nationality procedures are identified and addressed.
Procedural and other challenges cause delays in case processing which impact directly on the rate at which stateless cases are resolved and individuals are able to access legal identity and improve access to basic rights. These challenges range from those pertaining to accessing procedures to obtain birth registration and retroactive birth registration, to resource constraints processing nationality applications.
To this end, UNHCR commissioned the Revision of Nationality Procedures in Thailand: Bottlenecks Analysis and Recommendations in addressing implementation challenges (Bottlenecks Study), which was conducted by Chiang Mai University to assess the statelessness situation in Thailand and in specific areas where stateless persons have resided and faced administrative challenges in nationality and legal status related issue which contains 193 pages. UNHCR is interested in having a summary of the Bottlenecks Study (Summary Report) prepared for advocacy and wider consumption. The initiative is intended to support the RTG in addressing statelessness and aligns with the pledges Thailand made at the Global Refugee Forum (GRF) in December 2023. These pledges include cover a range of issues related to statelessness, including to develop, within two years, a national action plan on the reduction of statelessness. The preparation of the Summary Report, would support the development of the National Action Plan by providing updated input on current bottlenecks and how to resolve the challenges in civil registration and nationality procedures in Thailand. The Summary Report will also be used in raising public knowledge of the issue and sharing with concerned stakeholders (academia, NGOs, CSOs, parliamentarians and others).

1. Key objectives
To summarize, for publication, the Bottlenecks Study through a Summary Report. Such study reflects the statelessness situation in Thailand and in specific areas where stateless persons have resided and faced administrative and other challenges in resolving nationality and legal status related issues. The main goal for the Summary Report is to develop a document that can be used widely for both internal purposes and shared externally, particularly for advocacy and awareness raising purposes. The key points from the Study shall be addressed, and the language used shall be easy to understand amongst the public and a wide array of stakeholders.

2. Scope of work

Prepare the summary of key issues as well as the Summary Report of the Bottlenecks Study with the goal for publication (15-20 pages max).

The Bottlenecks Study includes a number of area reports, which focus on the implementation of relevant procedures at the provincial and district levels. The area reports were used to inform the development of the main report. The consultant is expected to read both the main report and area reports and ensure that relevant key findings from these documents are incorporated in the Summary Report.

The Summary Report will focus on priority areas of concern for UNHCR as outlined in the Bottlenecks Study and align with UNHCR standards in relation to its mandate to identify and protect stateless people and to prevent and reduce statelessness. Guidance from UNHCR will be provided on these areas of concern prior to the beginning of the work. Further, the consultant will share with UNHCR a summary of the key issues and recommendations for inclusion in the Summary Report to ensure agreement between UNHCR and the consultant on the substance of the Summary Report in advance of drafting the latter.

3. Qualifications

Ph.D. in Social Studies, Sociology or Education;
At least 5 years of experience in the filed of statelessness and/or refugees in Thailand;
Experience working on research related to statelessness in Thailand;
Recent experience in working with UN agencies in preparing research documentation in Thai and English;
Excellent comprehension and drafting skills in both Thai and English

5. Payment terms

1st payment: 40 percent of the contractual value Upon submission and acceptance of Deliverable 1
2nd payment 30 percent of the contractual value Upon submission and acceptance of Deliverable 2
3rd payment: 30 percent of the contractual value Upon submission and acceptance of Deliverable 3

Remarks: Prior to the assignment, the consultant shall have a meeting with UNHCR for guidance and advice.
