About the Basel Institute on Governance
The Basel Institute on Governance is an independent non-profit organisation working across sectors to counter corruption and related financial crimes and to improve the quality of governance. Registered as a Swiss foundation with headquarters in Basel, the Institute works globally to advance knowledge, practice and policy on anti-corruption, asset recovery and business integrity. With field operations worldwide, it has some 130 staff from 28 nationalities. The Basel Institute is an Associated Institute of the University of Basel.
The Basel Institute’s Green Corruption programme focuses on applying our in-house expertise and experience in relation to the prevention of corruption and the enforcement of anti-corruption and anti-money laundering standards in the environmental sector. The programme covers corruption and financial crime related to the illegal trade in wildlife, forestry and timber products, fish and mining.
Project: Promoting asset recovery techniques in crimes against the environment and preventing environmental corruption in Latin America
The Basel Institute is planning to carry out a scoping mission to learn about and analyse the main requirements of the Brazilian justice system in terms of judicial prosecution and asset recovery in environmental matters. The goal is to then design and implement a training programme on asset recovery and financial investigation for law enforcement officers in Brazil.
Assignment
The objective of this consultancy is to provide technical advice to the Basel Institute team in charge of the scoping mission to Brazil on the preparation of a training programme on international judicial cooperation, asset recovery and financial investigation in environmental crimes, aimed at investigators, prosecutors, public prosecutors, officials of the financial intelligence unit and others involved in criminal prosecution.
Activities and timeline
The Consultant will be contracted from 1-30 November 2024 to conduct the following activities, divided into two parts:
During the first part of the contract (1–8 November 2024), the Consultant will work on:
- identifying and collecting the relevant rules and regulations, as well as federal and state case law, most relevant to the development of the training programme;
- assisting the coaching team in the collection of any other information necessary for the development of the training programme;
- identifying the main actors and authorities involved in asset recovery, judicial cooperation, and prosecution of environmental crimes in Brazil;
- arranging the agenda of meetings with the relevant authorities for the development of the scoping mission;
- supporting the preparation of questionnaires; and
- holding virtual meetings with the Basel Institute’s team.
During the second part of the contract (11–30 November 2024), the Consultant will work on:
- accompanying the team in charge of the scoping mission to Brazil in the interviews with the Brazilian authorities;
- gathering information from the authorities involved;
- organising the information obtained during the scoping mission to Brazil; and
- developing a report on the regulations applicable in Brazil regarding asset recovery, criminal investigation and international judicial cooperation in relation to environmental crimes.
Deliverables
- Initial report by 11 November 2024
- Final report by 30 November 2024
Reporting
The Consultant will work under the supervision of the Senior Specialist, Asset Recovery of the Knowledge Management Centre.
Qualifications
- Brazilian lawyer with the legal permission to work in Brasilia, Brazil.
- Proven experience and knowledge in the functioning of the system of administration of justice and criminal prosecution, as well as in criminal matters, asset recovery and criminal procedure (preferably in public institutions such as the Public Prosecutor’s Office, the Judiciary or the Office of the Attorney General of the Union).
- Native-speaking level of Portuguese. Excellent writing skills in both English, Spanish and Portuguese/Brazilian.
- Proactivity, ability to work in a team and under pressure.
- Service-oriented profile and responsive to the needs of the beneficiaries.
