JOB DESCRIPTION

Background:

 

The OSCE Mission in Kosovo Governance Sections (GS) 2023 project Promoting Quality in Public Processes II under the Activity 2.1. on Enhancing the internal professional capacities of the IOBCS and its promotion will continue to support the effective functioning of the Independent Oversight Board for Civil Service of Kosovo (IOBCS), among others, by updating and improving its internal regulatory framework.

The IOBCS is an independent institution that ensures governmental compliance with civil rules and arbitrates civil service staff complaint. Assistance to the IOBCS is part of the Missions’ overall support in enhancing the efficient oversight role of the independent institution over the governments’ compliance with rules and procedures. Therefore, an effective and efficient IOBCS is crucial to create a safe environment for the public officials, including the existence of internal regulations, guidelines and rules of procedure that regulate the internal processes of work.

Although most of the sub-legal acts foreseen by the Law on IOBCS  have been drafted and harmonised with legislation changes, Article 30 point 2 of the law foresees issuance of any other sub-legal act/s that the institution finds necessary for execution of their work. The IOBCS has identified the need to draft two such legal-acts and update one existing regulation. Therefore, the Mission will contract a local legal expert to support IOBCS in drafting two sub-legal acts and in amending the IOBCS rules of procedure, which needs to be harmonised with the latest changes to the respective legislation such as the new laws on public officials.

 

Objective of Assignment: 

 

Support the IOBCS in drafting two sub-legal legislation foreseen by the Law on IOBCS, and harmonising its existing rules of procedure, enabling better implementation of the law and increased efficiency of their work.

 

Duration of Assignment:

 

The consultant will be engaged for 40 days.

 

Tasks and Responsibilities:

 

The local legal expert will report to the Governance Section (GS) Activity Manager and work closely with other members of the GS team and will be tasked to:

  1. Amend the IOBCS rules of procedure;
  2. Draft the Regulation on keeping the archive and protocol material;
  3. Draft Guidelines for the IOBCS secretariat work;
  4. Prepare the draft final report for the submission to the GS Project Manager.

 

Deliverables:

 

The local legal expert will report to the Governance Section (GS) Activity Manager and work closely with other members of the GS team in submitting the following deliverables:

  • Submit the amended draft regulation on IOBCS rules of procedure by the end of April;
  • Submit the draft Regulation on keeping the archive and protocol material by mid-June;
  • Submit the draft Guidelines for the IOBCS secretariat work by mid-August;
  • Submit the final report on the work carried out in support of the institution by the end of September.

 

Performance Indicators:

 

  • The draft Regulation on IOBCS rules of procedure amended, within the agreed timeframe, and to the quality accepted/agreed upon by IOBCS;
    The draft Regulation on keeping the archive and protocol material drafted, within the agreed timeframe, and to the quality accepted/agreed upon by IOBCS;
    The draft Guidelines for the IOBCS secretariat work drafted, within the agreed timeframe, and to the quality accepted/agreed upon by IOBCS;
    Effective and efficient communication with the GS team and with officials from the IOBCS;
    Participation and co-facilitation of the working group/meetings during the activity implementation;
    Flexible on possible new instructions to be taken into consideration which may derive from the GS team through his/her assignment;
    Timely and qualitative submission of all the deliverables and other products that are foreseen in the ToR-s, or new tasks that might be agreed upon during the implementation of the works;
    Final report submitted on time and to the quality agreed upon with the GS Project Manager.

The expert will work closely with the IOBCS General Secretary and the team.

 

Necessary Qualifications:

 

  • University degree in Public Administration, Law, or a related discipline;
  • At least five (5) years of relevant professional experience, preferably in drafting legal acts;
  • Specific knowledge in drafting of subsidiary legislation is an asset;
  • Excellent organizational skills with capacity to deal effectively with changing priorities;
  • Command of Windows software, Microsoft Office and Microsoft Outlook;
  • Ability to meet strict deadlines and deal with several activities simultaneously;
  • Fluent in Albanian and English, knowledge of Serbian is an asset.
