National legal consultant on development of the Concept on a shared service center for the FEZ entities

Background:

Serving as a tool for boosting investment potentials and offering business incentives through a set of legal norms, special conditions for taxation, currency circulation, customs, labour relations and favourable conditions Free Economic Zones (FEZ) of Tajikistan are aimed to bring direct local and foreign investment into five created zones. The geographical span of the zones are allowing to invest into long-term investment projects thereby improving investment climate ranking. 
In close co-operation with the Ministry of Economic Development and Trade (MEDT) the OSCE Programme Office in Dushanbe (POiD) targets to support in developing of the Concept of Digitalization of the shared service center that would support further structurize resilient and sustainable regional economic development via applying strategic approaches to FEZ and facilitate to digital economy agenda. 

Objective of Assignment: 

Support to the Ministry of Economic Development and Trade of the Republic of Tajikistan in developing the Concept of a single center for servicing the Free Economic Zones’ entities by applying best national and international legislative norms and provisions.

 

Duration of Assignment: 

Three months. 

 

Tasks and Responsibilities:
Under the overall supervision of the Economic Officer, the successful candidate will be tasked with the following duties:

  1. Developing a draft Concept for a shared service center for the FEZ entities in collaboration with an international consultant and ICT specialist;
  2. Conducting a legal examination of the current legislation of the Republic of Tajikistan regarding the digitalization of a particular industry that needs to be amended accordingly and develops draft amendments and additions to the relevant legal provisions and regulations;
  3. Interacting with experts and specialists in the field of digitalization of public and business services to reflect findings in a developed project and embedding the best ICT practices/solutions to automate business processes;
  4. Coordinating and promoting the draft Concept of a shared service center with the line ministries and agencies of the Republic of Tajikistan;
  5. Improving the draft Concept by taking into consideration possible comments and suggestions for its subsequent submission for approval to the MEDT’s Senior Management;
  6. Acting as a liaison in co-ordination with the implementing partners and stakeholders timely completion of the tasks and provision of an interim and final reports on the progress;
  7. Presenting of the draft Concept and participation in the meetings and negotiations with representatives of government agencies, the business community and international partners in order to promote the project and address possible comments/questions;
  8. If required, supporting with other activities aimed at achieving the goals and objectives in frame of the ToR.

Deliverables:

  • A draft Concept of a shared service center for servicing the FEZ entities is discussed and agreed with the line ministries and agencies;
  • A legal review of the current legislation of the Republic of Tajikistan relating to the digitalization of a particular industry, which needs to be amended accordingly, is conducted and a draft document of amendments and additions to the relevant legal acts are developed and presented to MEDT;
  • Upon co-operation with experts and specialists in the field of digitalization of public and business services, all findings for implementing the best ICT practices/solutions are embedded into an automated business process;
  • A Concept is prepared and sent to MEDT;
  • A draft Concept is improved by taking into consideration comments and suggestions and is submitted for review to the MEDT;
  • An interim and final reports on the progresses are prepared and submitted to OSCE POiD and MEDT; 
  • A draft Concept is presented during the meetings and discussions with representatives of the government agencies, business community and international partners where a project is widely promoted and possible comments/questions are addressed;

 

Necessary Qualifications:

  • Degree in law and proven ten years of professional experience in legal sphere;
  • Good knowledge of laws and provisional legal norms as well as other strategic documents of the Republic of Tajikistan;
  • Experience in drafting legal acts, in particular concepts for establishing a single window for provision of public services (laws, regulations, etc.);
  • Negotiation skills and proven experience in working with government agencies, non-governmental and international organizations;
  • Computer skills in Windows, MS Word, MS Excel, Internet (E-Mail) and skill of leading an official and business correspondence;
  • Fluency in Tajik and Russian languages (both spoken and written);
  • Demonstrated gender awareness and sensitivity, and an ability to integrate a gender perspective into tasks and activities;
  • Ability and willingness to work as a member of team and complete assigned tasks in a short period of time, with people of different cultural, and religious backgrounds, different gender, and diverse political views, while maintaining impartiality and objectivity.

Remuneration Package:

Remuneration will be based on the selected consultant’s/expert’s qualifications, experience, the tasks and deliverables for this position and in accordance with the OSCE established rates.
