CONSULTORIA PARA DESENVOLVIMENTO DE SUBSÍDIOS PARA A ELABORAÇÃO DA NORMA DE REFERÊNCIA DE REVISÃO TARIFÁRIA PARA OS SERVIÇOS PÚBLICOS DE ABASTECIMENTO DE ÁGUA E ESGOTAMENTO SANITÁRIO

 

No setor de saneamento básico brasileiro a regulação é feita de forma descentralizada por diversas entidades reguladoras infranacionais (ERIs), que podem ser estaduais, municipais ou intermunicipais. Segundo a Constituição Federal, a titularidade dos serviços de saneamento básico é atribuída aos Municípios por tratar-se de serviço de natureza local, diferentemente do que ocorre na gestão e regulação do uso dos recursos hídricos que é de responsabilidade dos Estados e da União.

Considerando a necessidade de elaboração de diversas normas em um contexto de regulação tarifária, e o reduzido quadro de pessoal da ANA, entende-se que seja necessário contratar consultoria técnica especializada para produzir subsídios para a elaboração da norma de referência de revisão tarifária para os serviços públicos de abastecimento de água e esgotamento sanitário em consonância a lei do Novo Marco de Saneamento (Lei 14.026, de 15 de julho de 2020), notadamente quanto aos princípios que orientam a concepção e aplicação, devendo ser observadas as especificidades do setor e suas melhores práticas vigentes.

CONSULTANCY TO DEVELOP SUBSIDIES FOR THE PREPARATION OF THE REFERENCE STANDARD FOR REVIEW OF TARIFFS FOR PUBLIC WATER SUPPLY AND SEWAGE SERVICES

In the Brazilian basic sanitation sector, regulation is carried out in a decentralized manner by several subnational regulatory entities (entidades reguladoras infranacionais—ERIs), which may be state, municipal or intermunicipal. According to the Federal Constitution, ownership of basic sanitation services is attributed to the Municipalities due to their local nature, which differs from the management and regulation of the use of water resources, which is the responsibility of individual states and the Union.

Considering the need to draw up several standards in a context of tariff regulation, and ANA’s reduced staff, it is understood that it is necessary to hire a specialized technical consultancy to produce inputs for the preparation of the reference standards for tariff revision of public water supply and sewage services in accordance with the New Basic Sanitation Framework (Law 14.026, of July 15th, 2020), notably regarding the principles that guide the conception and application. The specificities of the sector and its current best practices must be observed.
