TERMS OF REFERENCES OF
MIGRATION SITUATION ANALYSIS IN IRAQ
IRAQ DELEGATION
1. PRESENTATION OF TERRE DES HOMMES IRAQ
Terre des hommes (Tdh) started its operations in Iraq in December 2014, responding to the
emergency needs of children, youth and families affected by the ISIL-driven crisis. Due to the
rapid deterioration of the situation of people affected by the crisis, Tdh scaled up its
interventions to 12 districts within 5 governorates (Anbar, Kirkuk, Ninewa, Baghdad & Salah
al-Din), providing emergency and humanitarian assistance in the sectors of child protection,
juvenile justice, education, and WASH.
As of January 2024, 1.1 million Iraqis remain displaced throughout the country,
approximately 175,000 of those IDPs were living in 23 formal camp locations in the IKR; no
formal IDP camps remain in federal Iraq. Also, there were more than 300,000 refugees and
asylum-seekers – including 270,000 Syrian refugees – displaced in Iraq, the vast majority in
the IKR. Refugees and IDPs face a heightened risk of forced labor and trafficking due to their
economic and social vulnerability, lack of security and protection, and alleged affiliation with
extremist groups according to the 2024 Iraq TIP Report.
Iraq is facing multiple types of movements including internally displaced people, returnees
from Syria, refugees, and migrants. Tdh is committed to extending its actions to internally
displaced children and youth and will strengthen their access to humanitarian aid,
development aid, and peace. Through its 2022-2024 Iraq strategic plan, Tdh Ambitions is to
strengthen the protection system for children and youth in displaced settings as well as in the
areas of return with a particular focus on access to prevention and response mechanisms and
empowerment interventions with a specific focus on the most vulnerable particularly those in
displaced situation, in the areas of return or at high risks of trafficking/migrating.
This Situation analysis seeks to establish an understanding of the context, needs, and
vulnerabilities of the children and youth on the move (CYM – refugee children, migrant
children, displaced, left behind, asylum seekers, trafficking survivors, etc) and their
communities, as well as available resources, capacities, existing interventions and actors in
order to support the design of quality projects. This analysis is aimed to provide evidence on
the updated needs within Iraq for those vulnerable communities and to inform future
programming for Tdh-L Iraq delegation by providing a comprehensive understanding of the
migration situation within Iraq.
2. BACKGROUND AND RATIONALE
Migration in Iraq is characterized by a complex interplay of internal displacement, refugee
influx, and international migration, driven by ongoing conflicts, political instability, and

economic challenges. According to reports from the International Organization for Migration
(IOM) and the United Nations High Commissioner for Refugees (UNHCR), Iraq has
experienced significant displacement within its borders, with millions of Iraqis having been
internally displaced due to conflict and violence, particularly in the aftermath of the 2014 rise
of the Islamic State of Iraq and Syria (ISIS). The leading causes are endemic poverty,
development inequalities, the chronic fragility of states, weaknesses in their protection,
education and economic integration systems, the resurgence of armed conflicts and other
situations of violence, and climate change. Migration has a profound impact on the living
conditions and development of children and youth. They represent nearly 20% of so-called
economic migrants (internal and international) and more than half of those forced to move
(internally displaced, refugees, and asylum seekers). Whether forced or by choice, their
mobility is often the cause or consequence of violations of their rights, including lack of
access to essential services. Tdh is committed to defending the rights of children and young
people affected by migration (CYM). This involves guaranteeing them:
• the recognition and promotion of their fundamental rights: these rights must be
enshrined in legal, strategic, and political frameworks at national and international
level; their implementation must be effective at the level of protection systems and
services.
• protection adapted to their profiles (problems often linked to their status) and to the
concrete situations along the migratory routes, which implies covering and linking
zones of origin, passage, transit, destination, and return/resettlement.
• adequate support and capacity building for self-reliance and resilience, enabling them
to seize development opportunities, integrate or reintegrate locally, and to improve
their futures prospects.
This situational analysis seeks to provide a thorough understanding of the current migration
issues-trends, challenges, and dynamics in Iraq, focusing on the specific vulnerabilities and
needs of migrant children and families. It will also evaluate the effectiveness of existing legal,
social, and protection mechanisms to inform the development and program design of Tdh
Lausanne’s migration programs and strategies in Iraq. Engaging with key stakeholders,
including government agencies, NGOs, and community leaders, will ensure coordinated and
comprehensive support for migrants. Study stakeholders can include the Migrants
community, Government Agencies: Ministry of Migration and Displacement MoMD, Ministry
of Labor and Social Affairs MoLSA and Ministry of Interior MoI, International Organizations:
United Nations High Commissioner for Refugees (UNHCR), the International Organization for
Migration (IOM), United Nations Children’s Fund (UNICEF), other relevant civil society
organizations and Academic and Research Institutions. The study will be looking at different
targeted groups including Refugees: Syrian refugees and other non-Iraqi nationals seeking
asylum in Iraq, refugee children, and families living in camps or urban settings. Migrant
Workers: Labor migrants facing exploitation, poor working conditions, or legal challenges,
migrant children, particularly those unaccompanied or separated from families. Also,
Returnees: Individuals and families returning to Iraq after displacement abroad and
Returnees facing reintegration challenges and requiring support services.

3. OBJECTIVE OF THE SURVEY
General Objective: To gain a comprehensive understanding of Iraq’s migration issues-trends,
challenges, and dynamics, including push and pull factors, and to identify the specific
vulnerabilities, needs and obstacles that migrant children and families face when they access
services and rights. This includes evaluating the effectiveness of current protection
mechanisms to inform and refine Tdh Lausanne’s migration programs and strategies.
Additionally, the objective aims to foster collaboration with key stakeholders for coordinated
and comprehensive support for migrants.
Specific Objective:
• Analyse the current migration context -trends within Iraq, including internal
displacement, refugee movements, cross-border migration, and Trafficking in Person
(TIP) regarding migrants, and specifically children and youth on the move.
• Review and analyze existing legal and policy frameworks governing migration in Iraq
and the current administrative practices towards CYM, including international
conventions, national laws, and local regulations, and bilateral and multilateral
agreements.
• Identify existing platforms and processes to which Iraq is a party that address
cooperation, migration, internal displacement, TIP and smuggling, education, and
labor mobility (if any)
• Identify national and regional advocacy frameworks that support children and youth
on the move (if any).
• Identify the specific protection risks including trafficking or any other forms of
exploitation, violence and abuse, lack of access to basic services, psychosocial and
mental health issues, and legal and social discrimination among others.
• Identify needs of migrant children and youth, including issues related to safety, access
to information, access to legal and basic services (particularly for unaccompanied and
separated children) such as legal documentation, access to education, health, and
psychosocial support; and needs related to local integration.
• Identify community-based protection mechanisms and organizations supporting
children, youth, and families, and identify best practices and areas for capacity
building.
• Identify and map actors and stakeholders working with children, youth, and families
affected by migration in Iraq, including the services they offer, their accessibility, their
roles, responsibilities, and areas of intervention.
• Identify actors involved in producing information on migration in Iraq, including
research centers, think tanks, foundations, and others

4. METHODOLOGY
The consultant should identify and clearly describe the relevant methodology to undertake
for the successful addressing of the specific objectives stated in section three and delivery of
this situation analysis in their technical proposal. The analysis should adopt a mixed-method
cross-sectional design. This will draw from existing data and records, desk review as well
undertake primary data collection focusing on qualitative information.
5. AUDIENCE AND USE OF FINDING
The findings of this analysis will be used to enrich the knowledge and understanding of the
migration context in Iraq. It will also contribute to strategic program design and to identify
appropriate and relevant interventions for children, youth, and families affected by
migration. Although the documents will be used internally, however, it might be shared with
relevant stakeholders such as NGO working group members and/or local authorities.
6. KEY SOURCES – TARGET GROUPS AND PEOPLE TO BE CONSULTED
This migration situation analysis should cover Iraq (GOI and KRI). The general understanding
should come from actual stakeholders in the sectors of migration, protection, education, and
home affairs, including local authorities, national authorities, community members, local and
international NGOs and any other relevant stakeholder based on the stakeholder analysis will
be carried as a part of the consultancy.
If possible, consult with persons who can be considered as a victim of trafficking and other
forms of exploitation and abuse to understand their current circumstances in Iraq and KRI.
7. ETHICAL CONSIDERATIONS
The consultant is obliged to respect the following ethical and child protection requirements:
• Conflict of interest: The consultant must demonstrate the necessary independence
and declare any conflict of interest and potential biases, including bias towards any of
the stakeholders, target groups, types of methodologies or approaches, social,
political, or religious prejudice.
• Based on rights and ethics: The consultant must respect the rights and dignity of
participants as well as comply with relevant ethical standards and Tdh’s Child
Safeguarding Policy. The analysis must ensure: age-appropriate, safe, non‐
discriminatory participation; a process of free and un‐coerced consent and
withdrawal and confidentiality of participants. The informed consent of each person
(including children) participating in data collection should be documented.
• Respect ‐ The consultant will respect the variety of children’s experiences, cultural
backgrounds, and perspectives;

• Beneficence ‐ The consultant will promote the wellbeing and interests of children and
ensure that the study benefits them.
• Non‐maleficence ‐ The consultant will ensure that the study does no harm, either
through action or omission, and puts in place measures to mitigate any possible harm
to all participants, but in particular children.
• Justice ‐ The consultant will balance the burden of participating in the study and its
benefits to ensure there is justice for children.
8. TIME FRAME
The expected starting date for the consultancy is by the 1st of August, and it should
be finalized within 6 weeks. The below suggested time frame is to clarify the
milestones of the consultancy:

9. DELIVERABLES
During and by the end of this consultancy, the below deliverables should be met:
• Inception report clarifying the methodology will be used for the analysis (1 week of
Contracting).
• A draft of the situation analysis due to (5 weeks of contracting).
• The final report due to (6 weeks of contracting) includes the below :
1. A situation analysis report of a minimum of 20 pages, without annexes shall
be submitted to the Tdh-L Iraq delegation including a clear Report structure
(An executive summary, table of contents, introduction, methodology, the
findings, recommendations, and list of annexes, abbreviations, tables, figures,
pictures).
2. The consultant should also conduct the below to inform the migration
situation analysis and add it as annexes to the report (Each should be a
minimum 5 pages specific document):
o The problems analysis
o The stakeholders’ analysis
o The resources analysis
o The risks analysis (based on the problems, stakeholders, resources, and
risks analysis)
o The donor Mapping

• PowerPoint Presentation reflecting the main findings of the analysis (6 weeks of
contracting)
• Annexes shall be included as sees fit.
10. PROFILE OF THE CONSULTANT (TEAM): QUALIFICATIONS AND EXPERIENCE
The lead consultant and the core research team should be collectively meeting the below
criteria:
• The lead consultant should have a post-graduate or equivalent qualification/degree in
Social Science, Human rights, Political Science, Development Studies, Humanities or
any other relevant discipline. Excellency level of analytical expertise in country/ sector
would be prioritized.
• At least 7-10 years of prior relevant experience.
• Proven sound experience on drafting similar deliverables (migration analysis,
situation analysis, context analysis, stakeholder mapping, donor mapping, risk
analysis and problem analysis).
• Proven skills in producing evidence-based reports on migration sector.
• Strong research and analytical capacity for conducting literature reviews and
synthesizing information into actionable recommendations.
• Knowledgeable and familiar with the context in Iraq.
• Excellent written and speaking skills in English and Arabic.
11. APPLICATION PROCEDURES
Local and international firms/individuals that are interested in implementing this assignment
are Invited to submit a proposal. Applicant to ensure all the required permissions such as
Visa, and right to work in Iraq. The estimated duration for the assignment is 6 weeks. Each
proposal should be typed in 12‐point font and submitted no later than 5:00 pm Iraq Time on
July 28, 2024. The proposal submission should include each of the following sections in the
specific order listed below to be considered for this consultancy:
• A technical offer comprising:
1. Understanding of the specific objective of the study and the Terms of Reference
(ToR).
2. Methodology and tools proposed.
• A financial offer with a budget detailed by item (fees, other costs);
• An updated and detailed CV of the consultant/firm and the involved team.
• Registration needed for registered Firms or Associations.
• Sign & Stamp Term of References.
• An example of similar analysis carried out.
• Contacts of 3 references.

12. PAYMENT TERMS & METHOD:
Payment will be made through several installments:
• The first installment is 50% upon the submission and approval of the draft report.
• The second and final installment is 50% upon the submission and satisfaction of:
1. A final report in English.
2. PowerPoint presentation with the main findings of the analysis in English.
3. Data collection tools and related materials.
4. All raw data and databases from primary data collection.
Payment Method: exclusively will be Paid through Cheque or Bank transfer or Hawala.
13. PROPOSAL EVALUATION AND SELECTION CRITERIA:
The evaluation of the proposals will be based on the following criteria:
